- I have an update to the situation regarding TheXvid suspending people's accounts. After speaking with people at TheXvid and coordinating with those that have been affected (with the help of my mods) I'm happy to the say that the problem is currently being worked on! It's not FIXED yet but things are moving in the right direction to make sure that this never happens again. Watch for the full details and please signal boost so people are aware.

"This should have never happened because they were copying and pasting" - Well, some live chats may actually want a spam rule. copying and pasting as many messages as you can is a red flag for any type of spamming. If I ran a live chat, I personally wouldn't want people spamming if I were trying to have conversations with my followers.
If anything came out of this I see two things: 1 TheXvid needs to allow creators to turn on or disable chat filters at their own choosing. This way you can allow spamming behaviour if you want. I can see why they have a limit. Imagine being a small channel with 50 people in a live stream, and 3 are in there just spamming messages over and over to ruin it. They need to be stopped or the creator needs the ability to remove them from the chats. Live chats with hundreds of people are just a shit show. I don't even bother participating in a live stream if messages are just rolling by and the creator is only responding to 1 out of every 100 messages. Waste of time and most people use them just to spam ridiculous things to get a rise out of people. It's a real problem for some channels who are involved with Drama. You get tribal fans raiding live chats and spamming. This is a legitimate issue.
#2 A lot of TheXvidrs run contests and polls with their viewers. A quick polling feature might be useful to avoid the Spam issue.
The context of this is that Markiplier was OK with spamming. The problem is, what some of those users were doing was the definition of spamming. This is where the creator needs the power to say, I want them to be able to spam my chat.
It's more of a - how do we handle this situation because different people are going to want different behavior behind the scenes.
The real issue here is the manual review. It's at such a large scale and the problem it's totally out of nearly every technological companies hands as it continues to grow.
My guess is, reviewers probably have to get through hundreds if not 1000's of reviews a day. That means you have only so much limited time to investigate. My guess is, they get a case, they see why: oh user sent 100 messages in less this amount of time - reject. All handled within less than 30 seconds.
You could argue, well they should handle every case with care and time and context. Impossible. Literally is. You can want that, but it ain't going to happen. It's not a solution to hire more manual reviewers. It just isn't. Advances in A.I and machine learning are going to be required and that's still in its infancy.
Rather than they are villains, I'd like to hear some legitimate ideas about how they could solve that process?

It's funny how THIS seemed like TheXvid's "big problem". Here we are, less than a month later and we all see that TheXvid has a MUCH bigger problem.
We need to address coppa more :(
They really should look at plagiarist channel such as Calon Sarjana whose contents are only copy paste from other channels without asking for permission or even citing the sources, add dubbing in other language, then claiming those videos as their own. They have Millions subs and taking the ads money for such disgusting practices.
Hey Mark how do you feel about coppa other communities will get effected like my community is gonna get effected we won't Be able to have stories have a comment section or anything like that and it's effecting a lot of communities it's got creators in my community crying, depressed, dark thoughts and if my community is hurting and being effected like this it makes me very disappointed at how TheXvid forgot about TheXvid kids TheXvid is taking our freedom of talking to a fans and our fans are our family when we're down they bring us back up like a fellow creator I know and I'm a fan of she had her depressed moments but our family in my community it huge and coppa is taking us all down if they think our content I kid friendly cause my community is a chibi community called the gacha community the stupid thing is if we say our videos are not kid friendly and TheXvid says they are regardless what things could be in the video there might be a fine for us to pay and most of the people in my community are 13+ or lower yet we all still has gore & profanity and they may still have us on kid friendly that isn't right I just wanna know your opinion on it and sorry if this is really long I just wanna hear someone else out of my community's opinion

This has nothing to do with this but I'll mention it anyway:
When ever I do the 10 second skip thing on TheXvid, right after the short pause I hear something that's half a second. It sounds like the entire video audio sliced into half a second and stacking all of that, *it sounds like earape*
All TheXvid content creators need to bring a class action suit against TheXvid/Google for one simple reason ~ ACCESS.
Collection of children’s data can ONLY occur if children have ACCESS to the TheXvid/Platform. Who defines and controls access to the platform? ONLY Google/TheXvid - not the content creators.
In fact, Google/TheXvid have consistently maintained the platform is for the above 13 crowd. That’s how it is marketed to the content creators. Do the analytics provided to the creators show an age breakdown below 13 years of age?
The LIABILITY for COPPA should rest with those responsible for ACCESS to the platform.
I think it is important to distinguish accountability for who should actually be responsible for the liability with regards to COPPA on the TheXvid/Google (hereinafter, TheXvid) platform.
So let’s simplify things - the issue is gathering children’s personal information.
The content creators do not collect that data. TheXvid does.
The content creators do not make the decisions regarding the use of that data. TheXvid does.
The content creators don’t solicit advertising for the TheXvid platform. TheXvid does.
The content creators don’t authorize access to the TheXvid platform. TheXvid does.
The content creators didn’t establish the 13 year old requirement to have a regular TheXvid account, the law did and TheXvid is responsible for ensuring adherence to that law.
Therefore all regular TheXvid content creators are under the valid assumption that ACCESS to the regular TheXvid platform is to the above 13 year old crowd. Content creators also know that if children are accessing their content through a valid, TheXvid account that the guardians have given implicit consent to do so by allowing their children to access that content through said account. Content creators whose target audiences are children, or even mixed audience, on the regular TheXvid platform rely on the ACCESS point (the Google or TheXvid account) to have been properly vetted upfront by Google/TheXvid.
It all boils down to the single point of entry to the TheXvid platform. And that control lies with TheXvid. TheXvid is trying to pass the buck and muddy the issue by creating smoke and mirrors with the “selections” content creators must choose when posting the videos. The liability should ONLY rest on Google/TheXvid.
While the content creators may specify who their target audience is, they ultimately should not be responsible - nor should be held accountable- for data collected by TheXvid and data used by TheXvid because ALL ACCESS to the TheXvid platform is controlled by TheXvid.
Mark, will you be affected by COPPA? you swear, so your channel isn't completely for kids, but your funny reactions to scary things, may be appealing to children.. I don't wanna lose you too!
Hey Mark, it's been a while since you've posted this video, but I just want to express my gratitude for you. I never got involved in this mess or even heard about this problem until NOW, but it sounds extremely terrifying to get your accounts banned. But after watching your vlogs I feel incredibly safe. I feel protected because you are willing to risk your account to save ours. You are willing to risk your TheXvid career to save our community. And I think I can speak for everyone else here that we are very thankful for that. You are amazing, Mark. And if there's a better word than amazing, you're that. Could you please make a video on how you feel about the latest updates with COPPA and the FTC? You are one of the most influential people here on youtube and you have power that not a lot of people could dream of having. The FTC released a new list of what counts as targeted towards kids and basically Animation channels and Game channels are done for. Even if we flag that the video is not intended for children you'll either be fined $42k, or your video will be deleted.
This so called"Andrew Smith" man the director of the FTC I think of him as a unexpectedly foolishly selfish fool who what TheXvid channels deleted even my old and new channels in the future I along with every TheXvidr around the world will have no respect for his stupidity and that he must leave his FTC career in shame that he is a discrace for a director himself along with him partners.
