    Watched this whole thing because I've been going down a "technical guy investigating being a manager of technical people who has also been on the other side of the desk in this situation" rabbit hole and this (even if 5 years old at this point) was very interesting (if difficult to acknowledge), thanks for the transparency here. This aspect (along with increasing my paperwork workload) have honestly been the scariest aspects of going in this direction for me, but I'm a person who eats the licorice jellybeans first so I knew I'd have to confront this topic first, if this career direction is indeed for me. I have a few questions: 1) The PIP, with its concomitant documentation, is a good idea legally, but I'm concerned about its negative side-effects on the person creatively and morale-wise... Pressure of this sort (like a guillotine hanging over your neck) has been found to be anathema to real creativity and in the course of doing this type of work, creative solutions are very much desirable (what I'm saying is, the very act of putting the person on a PIP is likely going to be an extra obstacle to them actually satisfying the job requirements outlined in the PIP!). Also, the data I've seen on PIPs shows that they're rarely successful. For these reasons, were I to receive a PIP, I would almost certainly (frankly) interpret it as "this employer is now going to be paying me for my time spent looking for another job while they play CYA with this paperwork game" and not "this is my last shot at impressing my team and manager". And for THAT reason, were I to be in a position of wanting to issue a PIP, here's what I'd do instead (something I read about recently which I think is GENIUS!): Pay someone to voluntarily leave by a certain date, or make me withdraw the offer prior to that date by increasing performance. That way, the risks/pains and rewards are more evenly distributed IMHO, and makes the whole experience of win/loss more shared. It also makes tangible the fact of "I am upset enough with your performance that this is how much I would pay for you to leave if you can't fix it, no hard feelings, best of luck". Plus, if they are unhappy, they're likely to take the lump sum, avoiding the whole uncomfortable discussion entirely. Anyway... 2) In a crafty job like development work (and unlike sales where metrics are more aligned with performance), it can be hard to nail down "fair" numbers that illustrate a performance issue (we all know the examples of bad metrics: LOC, etc.), so it made sense when (forgot who it was) mentioned primarily a "gut feeling" that performance was subpar. And that sort of speaks to the principle of focusing on feelings over facts ("are you making your manager feel like you are spending your time productively even if everyone knows there are unpredictable challenges whenever building new code"). The problem is, there's not a lot of rational i.e. legal ground to stand on. How do you balance needing to CYA legally while also just KNOWING that someone isn't sufficiently "tuned into" the work?
